## Chekhub Terms of Use

Welcome to the Chekhub web application (the “Chekhub Site”), owned and operated by Chekhub, Inc. (“Chekhub,” “we,” or “us”). This is an agreement between you or the entity that you represent ( “You”, or “Your”) and Chekhub governing your use of the Chekhub Web Application, Mobile App, and the Chekhub Site (collectively, the “Service”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms of Use (these “Terms”), to the collection and use of your information as set forth in the Chekhub Privacy Notice.

### Use of Our Service

1. **Eligibility**: You may use the Service only if you can form a binding contract with Chekhub, and only in compliance with these Terms and local laws. Any use by anyone under 13 is prohibited.

2. **Chekhub Service and App**: You are granted a non-exclusive, limited, non-transferable license to use the Service for personal, noncommercial use. Chekhub may terminate this license at any time and reserves all rights not expressly granted herein.

3. **Chekhub Accounts**: Your Chekhub account gives you access to various services. You must provide accurate information, keep it updated, and secure your account password. You are liable for all activities under your account.

4. **Service Rules**: You agree not to engage in prohibited activities such as copying service content, sending spam, interfering with service security, or using the service for unauthorized purposes.

5. **User Content**: You retain ownership of your content but grant Chekhub a license to use it for providing services. Chekhub is not responsible for user content and may remove it at its discretion.

6. **Our Proprietary Rights**: Except for your User Content, all materials in the Service are owned by Chekhub and may not be reproduced without permission.

7. **Payment Terms**: Fees depend on the selected tiers. We use Stripe for payment processing.

8. **Privacy**: We comply with applicable data privacy laws. By using the Services, you consent to the collection and use of your data.

9. **Security**: We cannot guarantee absolute security of personal information. You provide it at your own risk.

10. **Third-Party Links and Information**: The Service may contain links to other sites which are not controlled by Chekhub. We are not responsible for those sites.

11. **Indemnity**: You agree to indemnify Chekhub against any claims arising from your use of the Service or breach of these Terms.

12. **No Warranty**: The Service is provided “as is” without warranties. Chekhub does not guarantee service availability or effectiveness.

13. **Limitation of Liability**: Chekhub is not liable for indirect or consequential damages. Liabilities for claims will not exceed amounts you paid.

14. **Governing Law**: These Terms are governed by the laws of the State of Delaware. Legal action must be taken in certain courts in Delaware.

15. **Additional App Store Terms**: If you acquire the App from the Apple App Store or Google Play Store, respective terms apply.

### General

1. **Assignment**: You may not transfer rights without Chekhub’s consent.
2. **Notification Procedures**: Chekhub may notify users of changes via email or website posts.
3. **Entire Agreement**: These Terms constitute the complete agreement between you and Chekhub.
4. **No Waiver**: Chekhub’s failure to enforce a term does not waive its right to enforce any terms later.
5. **Cancellation**: You may terminate this Agreement with 30 days' notice.
